Terms of Service

1. Program Description

This AI-powered SMS Fitness Coaching Program (the "Program") delivers personalized fitness coaching, workout plans, nutrition guidance, daily check-ins, motivational messages, and program updates via SMS/MMS to enrolled subscribers. The Program is operated by Ashford SOHO ("we," "us," or "our"), located at 1863 Rock Glen Dr, Apt 308, Rock Hill, SC.

2. How to Enroll (Opt-In)

You may enroll by completing a web sign-up form and checking the SMS consent box, texting a keyword (such as START or JOIN) to our coaching number, or verbally consenting during enrollment with a representative. By enrolling, you expressly consent to receive recurring automated text messages at the phone number you provided.

3. Message Frequency

Message frequency varies based on your coaching tier and program activity. Subscribers may receive between 1 and 10 messages per day. Typical messages include workout reminders, check-in prompts, progress updates, motivational coaching, nutrition tips, and program announcements.

4. Message & Data Rates

Message and data rates may apply. These are charged by your wireless carrier, not by us. For questions about your text plan or data plan, contact your wireless provider.

5. How to Opt Out

You may cancel your SMS subscription at any time by texting STOP (or CANCEL, END, QUIT, or UNSUBSCRIBE) to your coaching number. After we receive your request, you will receive one final confirmation SMS and no further messages will be sent. To re-enroll, text START or sign up again on our website.

7. Eligibility

You must be at least 18 years of age to enroll in this Program. By enrolling, you represent and warrant that you meet this requirement. The Program is available to residents of the United States only.

8. Consent Not Required for Purchase

Consent to receive SMS messages is not required as a condition of purchasing any goods or services. You may purchase a coaching plan without consenting to SMS communications, though certain features are delivered exclusively via SMS.

9. Prohibited Use

You agree not to use the SMS coaching service in any way that violates applicable laws, carrier policies, or these Terms. Prohibited uses include sharing your coaching number with unauthorized third parties or attempting to interfere with or disrupt the service.

10. Disclaimer of Fitness & Medical Advice

The fitness and nutrition content delivered via this Program is for informational and general wellness purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or a qualified health professional before beginning any new exercise or nutrition program.

11. Disclaimer of Carrier Liability

Carriers (including AT&T, T-Mobile, Verizon, and others) are not liable for delayed or undelivered messages. We are not responsible for delays or failures in message delivery caused by your wireless carrier or factors outside our control.

12. Limitation of Liability

Ashford SOHO is not responsible for any delays, failures in delivery, or other issues related to the transmission or receipt of text messages. By enrolling, you acknowledge that we will not be liable for any damages, losses, or injuries arising from or related to the use or failure to receive any text messages.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Continued participation in the SMS Program following notice of changes constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by the laws of the State of South Carolina, without regard to its conflict of law provisions.

When you enroll in our SMS coaching program, we may collect: your phone number (required to deliver SMS messages), name (to personalize coaching), fitness information (goals, equipment, health limitations), message content (texts exchanged with the coaching program), payment information (processed securely via Stripe), and usage data (how you interact with the service).

3. How We Use Your Information

We use collected information to deliver personalized SMS coaching, process subscriptions and payments, send program updates and reminders, respond to support inquiries, comply with legal obligations, and improve our AI coaching technology.

4. How We Do NOT Use Your Information

We do not sell, rent, share, or trade your phone number or personal information with third parties for marketing purposes. Your opt-in data and personal information are not shared with any third parties for marketing or advertising without your explicit consent.

Text messaging originator opt-in data and consent information will not be shared with any third parties under any circumstances.

5. Third-Party Service Providers

We work with trusted service providers who may access your information only to perform their designated services: Twilio (SMS delivery), Stripe (payment processing — we do not store full card details), Anthropic (AI coaching intelligence — messages may be processed to generate responses), and Railway (secure cloud hosting). All providers are contractually obligated to protect your data.

6. SMS Data & Phone Number Usage

Your phone number is collected solely for delivering SMS coaching messages you have consented to receive. We retain message logs to maintain coaching continuity. You may request deletion of your message history at any time by contacting us.

7. Data Retention

We retain your information for as long as your account is active or as needed to provide services. If you opt out and close your account, we will delete or anonymize your personal data within a reasonable period, except where retention is required by law.

8. Data Security

We implement industry-standard technical and organizational security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. No method of electronic transmission is 100% secure.

9. Your Rights

You may have the right to access your personal information, request correction or deletion, opt out of SMS communications at any time (text STOP), and lodge a complaint with a supervisory authority. To exercise any of these rights, contact ashfordsoho@gmail.com.

10. Children's Privacy

Our program is not directed to individuals under 18. We do not knowingly collect personal information from minors. If we become aware of such collection without parental consent, we will delete it promptly.
